The fee prescribed by paragraph 6 [of Chapter 2 of Schedule 6 of the Civil Legal Aid (Scotland) (Fees) Regulations 1989] is chargeable for waiting for or attendance by a solicitor at the conduct of any hearing referred to in paragraphs 5(a) to (e), per 15 minutes. (1 unit) This does not include an evidential child welfare hearing.

Fees chargeable for waiting time

Fees are chargeable for waiting in connection with certain hearings and at the same level of remuneration as for the conduct of the proceedings. You can only claim waiting time in relation to attendance at the hearings specified in paragraph 5 [of Chapter 2 of Schedule 6 of the Civil Legal Aid (Scotland) (Fees) Regulations 1989] and it is only chargeable

  • From the time appointed by the court for the hearing to commence.
  • From the conclusion of any other business ending prior to the hearing commencing.

This should be whichever is the shorter time. Time engaged over lunch is not chargeable separately
