Glasgow City Council v SLAB judicial review case

A judgement was reported today in the judicial review petition of Glasgow City Council against the Scottish Legal Aid Board and PQ.

The Inner House of the Court of Session allowed SLAB’s appeal against the decision of the Lord Ordinary dated 22 December 2017.

The case concerned a judicial review of SLAB’s decision to grant legal aid to PQ. The Lord Ordinary had quashed SLAB’s decision because he considered that the applicant failed to give fair notice of his case to the authority whose decision was challenged.

We welcome the comments of the court in confirming the intention of the legislation and SLAB’s role. No changes will be required to SLAB’s processes as a result of the Inner House decision.
