6A.1  Cost Limitations on grants of civil legal aid

All grants of civil legal aid are subject to a cost limitation.  The cost limitation varies depending on the work covered by the grant.  We will tell you what level of funding you have when we notify you of the grant or restricted grant.  All cost limits are imposed under our condition making power in terms of section 14(1F) of the Legal Aid (Scotland) Act 1986.  Section 14(1F) states that a grant of civil legal aid made in terms of section 14 may be subject to such conditions as the Board considers expedient; and that such conditions may be imposed at any time.  Each cost limit is inclusive of all costs in the case.  It covers solicitors’ fees, counsel’s fees, use of experts and all other outlays.  The limits are exclusive of VAT for solicitors and counsel.

The standard cost limit is based on a combination of the primary category selected and the court in which proceedings are to take place.  When we take a decision to grant an application, in full or in part, we will notify you of the cost limit for that grant.  If the nature of the proceedings or the court changes after the grant is made and the initial limit is notified to you the cost limit in place will only be amended upwards.  There are no situations where a cost limit notified to you will subsequently be reduced.  As an example, a medical negligence case in the sheriff court has a standard limit of £10,000.  A medical negligence case in the Court of Session has a standard limit of £35,000. If we grant civil legal aid for a Court of Session action and the case is subsequently remitted to the sheriff court, the cost limitation in place will not drop to £10,000.  Conversely if we grant legal aid to raise proceedings in the sheriff court, whether this court is selected by you or we restrict the grant to cover sheriff court proceedings only and the case is subsequently remitted to the Court of Session the standard limit will increase to £35,000.

The cost limit is based on the primary category selected.  If there are ancillary craves these do not increase the standard cost limit applied to any grant.  For example, a divorce action with ancillary craves for contact and transfer of matrimonial property will have a cost limit of £6000 unless a request is made for additional funding at the outset and we agree to grant this.

Cost limitations put us in a broadly comparable position with other third party funders and private fee paying clients.  We can assess the on-going prospects of success for a case and determine the level of expenditure proportionate to it.

6A.2   Monitoring costs

It is important that you are aware of all costs being incurred as the case progresses including your own fees and any other outlays.  You should make sure that you have sufficient expenditure in place for all the work you need to undertake.  If you are submitting an application for sanction, you should consider at that time whether you have enough funding available to instruct any work that may be approved or whether you need to seek an increase in the limit.  You may find it useful to obtain estimates of costs not only for experts, unusual work or unusually large expenditure but also for any involvement of counsel in a case.  This will allow you to keep a track of costs being incurred against the grant of civil legal aid and to seek prospective increases in any funding limit in place where appropriate.

6A.3    Judicial expenses

The cost limits apply whenever payment of an account has to be made from the Fund.  If you obtain and accept judicial expenses in an action resulting in no claim being made on the Fund, the cost limit in place is not relevant.

6A.4   Applying for funding beyond the standard limit

Each category of civil legal aid has a standard or default limit. When you apply for legal aid it is, however, open to you to ask for a higher level of expenditure than the standard limit.  You can do this where you are aware at the outset of the case that it involves factors or issues likely to take the cost of the case beyond the standard limit.  Your application should identify the factors and issues that are likely to increase the cost of the case beyond the standard limit.  The factors may include:

6A.5 Seeking a review of the condition

If you ask us for a higher level of funding than the standard cost limit when you apply for civil legal aid and we refuse this request, you can seek a review of the condition imposed on the grant of legal aid in terms of the available expenditure.  Section 14(1G) allows the person receiving legal aid, subject to a condition imposed in terms of section 14(1F), to ask us to review any such condition.  You should apply for a review using the review application form.  The review should be supported by as much information as you have to show the need for expenditure beyond the standard limit. 6A.6 Applying for an increase in funding

Where we grant legal aid with the standard cost limit for that category of case and this is not sufficient to conclude the case you can apply for an increase in funding.  You should make your application for an increase in funding using the amend application.  There is no limit to the number of amend applications you can make seeking an uplift in funding. Where we are satisfied that the work to be done and the costs to be incurred are proportionate and reasonable for the dispute we will grant the application.  Your amend application needs to explain why the case cannot be concluded within the available expenditure and what work is needed to bring the case to a conclusion. It should also give up to date information about the going prospects of success for the assisted person.

6A.7 Monitoring of cases

For longer running cases where requests for funding are made beyond the standard limits in place, we may decide to monitor the progress being made in the case.  Where significant costs are likely to be incurred beyond the standard limit this monitoring could include asking you to provide regular updates on progress in the case and details of the steps or work needed to bring matters to conclusion.

Where you submit an amend application seeking an increase in the limit and there is more than one legally aided party involved  in the action, we will look at all the relevant grants of civil legal aid before we decide whether to allow the request for additional funding.  This will allow us to consider the overall public funding available for the case and whether all the grants of civil legal aid remain appropriate and proportionate.

6A.8 Retrospective authority

You normally need our prior approval to exceed the cost limit but we may grant an increase in the limit retrospectively if we are satisfied that the additional funding would have been agreed if the request had been made prospectively and that there is a good reason why prior approval was not applied for.  “Good reason” means more than simply forgetting to ask.  Examples of “good reason” may include where a party is ordered to meet the expenses of a particular outlay and the liability for this cost was not known in advance of the work being ordered or done or where additional court days are allocated for a case and there is no time to ask us for extra funding.  In some especially urgent situations work may be essential and there is no time to seek a prospective increase.  Each situation will need to be assessed on its own merits.
