Immigration and asylum

We are currently undertaking a review of our approach to and guidance on cases dealing with immigration and asylum matters and will produce more guidance in due course. However, our initial work has identified some issues which we want to bring to your attention because they may impact on our ability to pay you for work you have done.

Although there is sometimes a correlation between immigration and asylum work, they are different heads of work and we can only pay for work related to asylum when there has been a grant of legal assistance for asylum. If there is any work relating to immigration matters, we can only pay for work related to immigration when there has been a separate grant of legal assistance for immigration.

Accounts have been submitted to us that we have been unable to pay because no grant of legal assistance has been made for the work undertaken. So please ensure that you have the appropriate grant of legal assistance in place before you undertake work for which you intend to submit an account to SLAB.

In addition, the advice and assistance asylum templates do not cover making a fresh claim for asylum after the initial claim has been refused. A fresh grant of advice and assistance under the asylum category is required and, where appropriate, a standard increase should be applied for.
