Template 37 - Guardianship

Following enquiries about our recent update on template 37 we thought it would be useful to further clarify the removal of the ‘additional work’ item from the template.

Template 37 allows a solicitor to do all the work necessary to apply for legal aid.

The ‘additional work’ item to instruct and obtain a GP report was removed from the template as generally this is no longer needed to accompany an application for legal aid.

However, there may be circumstances which merit obtaining a GP report. For example, when seeking to oppose an application for orders on the basis that the subject is not an adult with incapacity, or where capacity is uncertain.

Where a GP report is needed, a standard increase can be applied for.
