Child Welfare Reporters in cases involving orders under Section 11 of the Children (Scotland) Act 1995

Please remember that to avoid difficulties and delays at the accounts stage our prior approval is needed for any child welfare report where the cost is likely to be in excess of £3,000, irrespective of whether the report has been ordered ex proprio motu or not [See Civil Handbook Part IV 7.44A]. 

Following the changes to the Court rules in relation to the appointment of child welfare reporters, effective from 26 October 2015, any application seeking sanction for the cost of a report in excess of £3,000 must be accompanied by a copy of the interlocutor detailing the work to be undertaken by the reporter.  A breakdown of the costs to be incurred setting out why the report will cost in excess of £3,000 is also needed.

You must always submit a sanction application for our prior approval if the cost will be in excess of £3,000. While there may also be occasions where you also need to ask us for an uplift in the cost limit to cover this extra expenditure it is important you are aware that obtaining an uplift in the case cost limit is not sufficient on its own as authority for the cost of a report in excess of £3,000.  Specific sanction is always needed.
