If the Reporter appeals a decision of the sheriff or Sheriff Appeal Court then the statutory merits tests of substantial grounds and reasonableness must still be satisfied where your client wishes to respond to the appeal and is one of the following:

  • A child (or someone acting on behalf of the child).
  • A relevant person (including a deemed relevant person).
  • An individual seeking deemed relevant person status (in certain appeals only).
  • A section 126 individual (in certain appeals only).

The Reporter cannot appeal against a children’s hearing decision under S154 of the 2011 Act.
