Bail appeals or interim liberation applications

The following paragraphs prescribe fees for bail appeals and interim liberation applications:

Where you claim for a bail appeal or interim liberation hearing we must be satisfied that the PF reference number provided by you matches with the PF reference provided by the agents when applying for legal aid.

Where we are not satisfied we must invite you to confirm the correct LARN and PF references.

5(a) and 5(ab) - Appeals in relation to bail or (applications for) interim liberation

Although contained within the Table of Fees for appeals these fees are much more likely to feature in the context of Part 1 and Part 3 first instance claims.

This fee is for all work and is payable at a standard rate depending on the status of counsel.

When is the bail appeal fee payable?

This fee is payable for all bail appeals under section 32 of the 1995 Act, or an appeal under section 201(4) of the 1995 Act.

This includes any appeal arising from a bail review under s30(4) and 31(4) of the 1995 Act.

Where a miscellaneous fee is charged, as opposed to a bail appeal, and we have information that suggests that a hearing was under one of the above sections, we must reduce the claim to the prescribed fee for a bail appeal and invite you to clarify the basis of your claim.

When is the interim liberation fee payable?

This fee is payable in respect of all interim liberation applications under section 112 of the Act of 1995.

5(b) - Application for interim liberation before three judges

This fee is payable at a standard rate depending on the status of counsel.

We must be satisfied that the work relates to an application for interim liberation before 3 judges before we can allow this fee.

It does not apply in any other case.

Multiple bail appeals on the same day

We may encounter a situation where there may be multiple bail appeals held on the same day that are covered under the same legal aid reference number.

Where we are satisfied that the legal aid grant covers more than one set of proceedings we may allow the fee for each separate bail appeal.
