Circumstances where we cannot grant prior approval

  • the employment of more than one counsel at a preliminary hearing
  • the employment of more than one counsel at a diet of deferred sentence.

These circumstances are covered by paragraph 3(eb) of the Notes on Operation of Schedule 2 of the Criminal Legal Aid (Fees) (Scotland) Regulations 1989. That paragraph lists the instances where payment can be made to more than one counsel and the regulations do not cover the circumstances listed above.

If we receive an application for prior approval of the attendance of more than one counsel at a continued preliminary hearing or a diet of deferred sentence we will refuse the application and refer you to Regulations.
