Civil legal aid accounts: activities covered by the conduct fee

This fee covers your attendance at the conduct of any of hearings not otherwise prescribed. It is payable either for advocacy or for attending with counsel and is payable at the same rates for each.

Aggregation of court time per day

Fees must be charged based on the total time engaged per day and are payable cumulatively between waiting and conduct time, rounded up to the nearest 15 minutes.

For example, if you have to wait for 10 minutes and then conduct a hearing lasting 8 minutes (total 18 minutes), you should claim a fee of 2 units (30 minutes) for that day (rule 19 of Chapter 2 of Schedule 6 of the Civil Legal Aid (Scotland) (Fees) Regulations 1989).

The fees are chargeable:

  • From the time appointed by the court for the hearing
  • From the conclusion of any other business ending prior to the hearing

This is whichever is the shorter time frame. This reflects the basis of taxation in detailed legal aid and judicial accounts.
