Criminal: Contempt proceedings at first instance: power of the court to assign you or counsel

Your legal aid client’s right to select their own solicitor and counsel is restricted in contempt of proceedings at the first instance [Section 30(2) of the Legal Aid (Scotland) Act 1986].

The court can:

  • Order the legal aid to consist of representation by you or counsel only.
  • Assign any solicitor or counsel who is within the precincts of the court at the time it makes the order.
