Where the Scottish Criminal Cases Review Commission (SCCRC) has referred the appeal to the High Court, legal aid is available without scrutiny of the merits of the appeal.

We still have to be satisfied as to the client’s financial eligibility, except where criminal legal aid was made available for the first instance proceedings.

You should send us a copy of the SCCRC’s referral with your application.
