As a duty solicitor am I obliged to undertake police station advice?

No.

  • When the SCL contact a duty solicitor, the duty solicitor is not required to provide advice or representation if they are unavailable to do so.
  • If the duty solicitor is not available because they are in court, giving police station advice to another client or are unavailable for personal reasons, that’s fine. The SCL will contact another duty solicitor.
  • The Code of Practice does not include an obligation on the duty solicitor to attend.
  • No action will be taken against duty solicitors who are unable to attend.
