Civil legal aid accounts: Sheriff Appeal Court and Sheriff court – Procedure for applying for an additional Schedule 6 inclusive fee

In sheriff court block fee proceedings [Schedule 6 of the Civil Legal Aid (Scotland) (Fees) Regulations 1989], we require that:

  • You apply to us either before sending us the account or in tandem with the account.
  • You do not make any motion to the court.
  • You set out each factor for which you are claiming an additional fee and the detailed circumstances to support each.

We will tell you the outcome or ask for further information, within 28 days of receiving the application.

If granted, we will write to you showing the additional fee percentage. If this is before you have sent us your account, send us a copy of this confirmatory letter with your account.

If we reject the application you can seek a review of the decision. We will consider the review application within 28 days.

This procedure also applies for proceedings in the Sheriff Appeal Court where fees are claimed under Schedule 6.
