Exceptions to lodging a fixed payments account

The Legal Aid and Advice and Assistance (Miscellaneous Amendments) (Scotland) (No.2) Regulations 2023 came into force on 29 April 2023.
This Guidance item was not affected but a copy has been placed with related guidance in the archive section for the regulations in force prior to 29 April 2023.

The provision of professional services in connection with “relevant” criminal legal aid and ABWOR is chargeable by way of fixed payments.

There are two circumstances in which the legislation allows for payment of detailed fees for the provision of professional services in summary criminal proceedings, whether by way of summary criminal legal aid or ABWOR, and these are

  • excluded proceedings
  • exceptional cases
