Fee applicable for framing citations in Adults With Incapacity and Children’s legal aid cases

We have amended our legal aid guidance on the framing of court forms for citations in Adults with Incapacity (AWI) and Children’s legal aid cases.

Why have we made the change?

The amendments have been made to align our guidance with the prescribed fees laid down in Schedule 5 that apply to civil and children’s legal aid accounts, which are chargeable on detailed fees.

The table of fees prescribes a non-formal framing charge for the framing of a citation, which includes the execution of service.

We have amended our guidance where reference was made to:

  • Forms 7, 20, 21 and 22 in AWI cases
  • Form G12 and G13 in Children’s cases.

What does the change mean?

Framing the Forms 20 and 21 in AWI cases will now be payable at the higher non-formal fee prescribed for a citation.

A separate fee will no longer be payable for the framing of the certificate of intimation of the citation, previously referred to as payable in our legal aid guidance, which applies to Forms 7, 22 and G12. This is because the framing of the execution of service is included within the prescribed fee for the framing of the citation.

In addition to the framing of a citation, you will be entitled to claim a signing fee for the citation and the execution of service, respectively.

A non-formal letter fee is chargeable for serving the citation.
