Notifying us when lodging expenses for a client

This update is to make you aware of our guidance on lodging expenses in favour of an assisted person.

There is a four month time limit for lodging of judicial accounts in the Sheriff Court, or eight months where lodged by us when taking steps under Regulation 39 to recover expenses.

The changes to the time limit were made as a result of the amendment of the Ordinary Cause Rules in April 2019, new rule 32.1A.

Full details are available in our legal aid guidance Our power to enforce payment of the expenses, which forms part of Expenses in favour of an assisted person.

The guidance explains that you must tell us immediately when expenses are due in a legal aid case and if you intend to take steps to recover these or not.

Please contact Carol Quinn in our Civil Finance team if you need more information.
