Reminder about the additional fee available at designated holiday custody courts

This update is to remind solicitors that an additional fee of £88.16 is available when representing an accused person appearing from custody when doing so on a day which has been designated a court holiday.

The Legal Aid and Advice and Assistance (Miscellaneous Amendments) (Scotland) Regulations 2022, which came into force on 1 April 2022 introduced this additional fee.

The additional fee applies to each case and can be claimed by both named and duty solicitors.

A generic fee has been created on our online system for the appropriate fee tables – below is an example of how the fee looks on selection of it from the drop down of fees available.
