The Legal Aid and Advice and Assistance (Miscellaneous Amendments) (Scotland) (No.2) Regulations 2023 came into force on 29 April 2023.
This Guidance item was not affected but a copy has been placed with related guidance in the archive section for the regulations in force prior to 29 April 2023.

The fee element of travel incurred in a case is subsumed within the various fixed payments, as is the case with all other fees.

The cost of travel, whether mileage if using a car or the cost of train ticket, is not chargeable where:

  • the travel is incurred in connection with taking a precognition, itself a fee, or
  • the travel is to a court in the town or place where you have a place of business, in terms of the criminal fees regulations, which apply

The rules are identical whether you are providing criminal legal aid or fixed payments ABWOR.

Otherwise, the cost of travel is separately chargeable whether mileage or cost incurred as an outlay.
