Determination provides cover for representation before the First-tier Tribunal (Asylum Support)

There is currently no provision in the legal aid regulations for cover in relation to representation before the First-tier Tribunal (Asylum Support).

To provide cover, the Scottish Ministers issued a determination in terms of section 4(2)(c) of the Legal Aid (Scotland) Act 1986, to allow for representation before the First-tier Tribunal (Asylum Support) under section 103 of the Immigration and Asylum Act 1999.

We have updated our legal aid guidance with full information about the determination, including:

  • conditions and restrictions for paying fees and outlays properly incurred by a solicitor in connection with representation
  • making an application on our online system.
