In accordance with Regulation 12 we must consider deprivation or conversion of resources when assessing an applicant’s financial eligibility for legal aid.
If it appears to us that the person has intentionally or unreasonably done something to a resources for it not to fall under consideration or done something to change the resources nature so it is then a resource disregarded, we will include that resource for assessment purposes as if they had not deprived themselves or converted that resource.
When considering Regulation 12 we will look at the timing and reasons for the disposal.
