Sanction for Counsel in Non Accidental Injury Proofs

We have updated the 2011 Act Children’s Handbook to outline our general approach to applications for counsel in a S101 proof where the Statement of Grounds concerns the alleged non accidental injury of a child.

The update specifically addresses our approach where we are asked for sanction for counsel at the outset of proceedings before you have done any preparatory work to consider the Reporter’s medical evidence.

This guidance can be found in Part III, Chapter 6, paragraph 6.11 of the Children’s legal Assistance Handbook.
